Terms and Conditions of Service

These terms and conditions govern all of our services. Please feel free to contact us with any questions.

1. Purpose

These General Terms and Conditions of Service (hereinafter “GTC”) govern the relationship between Marc Antoine Péan, operating under the trade name UMAMI Chef Privé, Sole Proprietorship — SIRET 914 785 530 00017, with its registered office located at 1650 route de Magescq, 40140 Soustons, France (hereinafter “the Service Provider”), and any natural or legal person using its services (hereinafter “the Client”).

2. Services Offered

The Service Provider offers private chef services at home, event catering (weddings, seminars, receptions), and culinary consulting. Each service is subject to a personalized quote prepared following consultation with the Client.

3. Contact Form and Quote

The contact form available on the umami-chefprive.com website constitutes a request for information and does not in any way constitute a booking confirmation. A booking is only final after both parties have signed the service contract and the deposit specified in Article 5 has been paid.

4. Allergens and Dietary Restrictions

The Client is required to inform the Service Provider, prior to finalizing the menu, of any allergies, food intolerances, or specific dietary requirements regarding the guests. The Service Provider will make every effort to take this information into account but cannot be held liable in the event of an omission on the part of the Client. Services are provided in an environment where common allergens (gluten, nuts, dairy products, etc.) are handled.

5. Payment Terms

The reservation is final upon receipt of the service contract signed by both parties and payment of a deposit of 30% of the total quote amount. The remaining balance must be paid no later than the day of the event. The final cost of the service may be adjusted based on the final number of guests and any necessary staffing adjustments.

6. Cancellation and Changes

In the event of cancellation by the Client, the deposit paid shall be retained by the Service Provider as compensation. Any cancellation made less than 120 days prior to the scheduled date may result in the full or partial billing of the service, depending on the costs already incurred by the Service Provider. Any significant changes (date, location, number of guests) must be communicated as soon as possible and may result in an adjustment to the quote.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to catering services provided on a specific date.

7. Client’s Obligations

The Client agrees to adhere to the payment schedule outlined in the contract, to provide the beverages required for the event unless otherwise agreed, to provide for equipment and materials not supplied by the Service Provider, to facilitate access to the event venue (including a preliminary visit if necessary), and to provide any information necessary for the smooth execution of the service.

8. Equipment and Logistics

The Service Provider shall provide its standard equipment, including a refrigerated trailer, a warming cabinet, and serving equipment for the cocktail reception. Any other materials (furniture, tableware, glassware, table linens, and any kitchen equipment not typically used by the Service Provider) shall be the responsibility of the Client and will be billed separately as rental fees.

9. Liability

The Service Provider holds professional liability insurance. The Service Provider undertakes to perform its services with all necessary care and diligence. The Service Provider shall not be held liable in the event of force majeure, the Client’s failure to provide the necessary information, or any event beyond its control. The Service Provider’s liability is limited to the total amount of the service in question.

10. Governing Law and Disputes

These General Terms and Conditions are governed by French law. In the event of a dispute, and in the absence of an amicable resolution, the competent courts within the jurisdiction of the Service Provider’s headquarters (Laval) shall have exclusive jurisdiction.
